OFFICIAL RULES
Effective
January 1, 2011, these Official Rules govern the Eurotard
Fundraiser Program and its Website, located at http://www.Eurotard.com/FUNDRAISER.html
(hereinafter referred to as ÒEurotard
FundraiserÓ). Eurotard
and Eurotard Fundraiser reserve the right to make
changes to these Official Rules at any time. Please check http://www.Eurotard.com/FUNDRAISER.html
regularly to ensure you are aware of any updates of changes. Your participation in the Eurotard Fundraiser Program indicates your acceptance of
these Official Rules, Terms of Use, and Privacy Policy.
Program Description
The
Eurotard Fundraiser Program is a program whereby 5%
of the ManufacturerÕs Suggested Retail Price (MSRP) of all qualifying orders
placed between January 1, 2013 and December 31, 2013 on http://www.Eurotard.com/FUNDRAISER.html
and fulfilled at a local participating retail store will be donated to a
registered school or dance studio (hereinafter ÒSchoolÓ). The School that will be the recipient of
the donation will be determined by the purchaser at the time the order is
placed on the Eurotard Fundraiser website. This offer is limited to orders placed
on http://www.Eurotard.com/FUNDRAISER.html. Order placed on www.Eurotard.com
are explicitly excluded from
this Fundraiser Program.
To
earn cash for a School, the purchaser must go http://www.Eurotard.com/FUNDRAISER.html,
select ÒFundraiserÓ and create an account.
Enter the purchaserÕs zip code, select the purchaserÕs school and class,
and select the retail store from which the purchaser would like to buy the
ordered items. The purchaserÕs
account will display the schoolÕs preferred retail store; however, the
purchaser may select a different retailer.
The purchaser must make a qualifying purchase by placing their order
online at http://www.Eurotard.com/FUNDRAISER.html,
receive the items from the selected retailer, and pay the merchant for the
purchase. The merchant will sign on
to the Fundraiser website with a secure merchant identification and validate
that all or a portion of an online order was filled. The School designated by the purchaser
will then be credited with 5% of the ManufacturerÕs Suggested Retail Price
(MSRP) for the purchase.
Eurotard
Fundraiser is not a direct seller of any merchandise to consumers. All orders will be processed through the
participating retail location selected by the purchaser.
The
Program allows the purchaser to designate a School to which the donation from a
qualifying purchase will be paid.
The designated School must be enrolled in the Eurotard
Fundraiser Program at the time the order is placed. If a purchaserÕs School is not
registered with Eurotard Fundraiser, it will not
receive the donation.
Eligibility
The
Eurotard Fundraiser Program is available to dance
schools, dance studios, liturgical dance programs, and private and public schools with dance programs,
cheerleading programs, gymnastics programs, or drill programs in the United
States and Puerto Rico. In order to
be eligible for donations, Eurotard Fundraiser
requires schools to provide proof of a business license, a federal tax
identification number, contact name, school or group name, business address and
telephone number. This information
can be faxed to 770-664-7208 or sent via electronic mail to pro@Eurotard.com. The prospective school must also
complete an IRS Form W-9 and provide Eurotard
Fundraiser with a copy of the completed form. Additionally, the prospective school
must complete the Eurotard Fundraiser School/Group
Validation Form and provide Eurotard Fundraiser with
a copy of the complete form.
In
order to receive payment for the Eurotard Fundraiser
Program, eligible Schools must be enrolled in the Program. Eurotard
Fundraiser reserves the right to limit the redemption of expired, invalid,
returned, or fraudulent purchases or validation forms.
Payments
Checks
will be made payable only to schools, studios, and groups with tax
identification numbers enrolled in the Eurotard
Fundraiser Program. Payments will
be sent out every three (3) months as follows: January
2, 2013, April 1, 2013, July 1, 2013, and October 1, 2013. Should
the day payment is to be sent out fall on a weekend or holiday, payment will be
mailed on the following business day on which Eurotard
Fundraiser is open for business.
The January 2, 2013 payment will reflect the amounts earned from July 1,
2012 through September 30, 2012. The
April 1, 2013 payment will reflect the amounts earned from October 1, 2012
through Decemeber 31, 2012. The July 1, 2013 payment will reflect amounts earned from January 1, 2013 through March
31, 2013. The October 1, 2013 payment
will reflect amounts earned from April 1, 2013 through June 30,
2013. Payments of less than $100.00
will be rolled over into the next payment term. Allow two (2) to four (4) weeks for
checks to arrive. Eurotard Fundraiser will not replace checks requested more
than six (6) months after the original check was issued. All donations made to the Schools are
not tax exempt.
The
5% donation is calculated based on the pre-tax MSRP of the items ordered. The online order must be placed prior to
purchasing the items at a local participating retailer. The items must be paid for at the
selected retail location. Only
those items actually purchased at the retail location will qualify for the
Program. If a purchaser changes an
item ordered online for one of a different color or size in the store at the
time of purchase, the item will still qualify for the Program if the new item
is the exact same style as the item ordered online. If a purchaser changes the style or
quantity of an item or items at the time of purchase, the new items will not
qualify for the Program.
In
the event the retailer sells the items ordered online at http://www.Eurotard.com/FUNDRAISER.html
at a price different from that on the website, Eurotard
Fundraiser will donate 5% of the MSRP to the qualifying and designated
School. Eurotard
Fundraiser will not lower the amount of its donation if the actual purchase
price is lower due to an in-store promotion, sale, or coupon. Eurotard
Fundraiser will not increase the amount of its donation if the retailer charges
in excess of the MSRP.
If
the participating retail location selected by the purchaser as the location for
the sale does not have the item(s) ordered, Eurotard
Fundraiser will ship the items to the retail location at the retailerÕs
expense.
Sales
taxes, shipping costs, gift certificates, packaging or handling fees,
gift-wrapping services, governmental fees, and certain other charges may not be
included in the calculation of the school donation amount.
School
donations are subject to adjustment if the purchase is later returned,
cancelled, or a refund is obtained from the merchant.
Submitted Ideas, Suggestions and
Information
All
comments, suggestions, ideas, notes, drawings, concepts, or other information
disclosed or offered to Eurotard Fundraiser shall be
deemed and shall remain the property of Eurotard
Fundraiser and Eurotard. Without limitation, by submitting any
suggestion, idea, or other information, you consent to its use by Eurotard Fundraiser in anyway Eurotard
Fundraiser or Eurotard deem appropriate or
necessary. Eurotard
Fundraiser and Eurotard assume no obligation, express
or implied, by considering or implementing any suggestion, comment or idea submitted
to Eurotard or Eurotard
Fundraiser. Without limitation, Eurotard and/or Eurotard Fundraiser shall be the exclusive owner of all
known or hereafter existing rights to the suggestions, ideas, comments, or
other information of every kind and nature and shall be entitled to
unrestricted use of the comments, suggestions, ideas, notes, drawings,
concepts, or other information for any purpose whatsoever, commercial or
otherwise without compensation to the provider.
Program Changes
Eurotard
Fundraiser reserves the right to cancel or alter the terms of the Fundraiser
Program at any time.
Redemption
Once
the online order is purchased at the selected participating retail location,
the retailer must validate the purchase.
The merchant will sign on to the Eurotard
Fundraiser website with a secure merchant identification and validate that all
or a portion of an online order was filled. The retailer must validate the purchase
within three (3) months of the purchase date. The validation must then be submitted to
Eurotard Fundraiser for processing and
verification. This offer is limited
to orders placed on http://www.Eurotard.com/FUNDRAISER.html.
Program Deadlines
This
program only applies to online orders placed between January 1, 2013 and
December 31, 2013. All validations must be completed by the retailer by September
30, 2013. All submissions are
subject to verification.
Any
participating School promoting the sale of, or knowingly submitting fraudulent
verifications will be subject to expulsion from the Fundraiser Program and will
forfeit all donations earned from this program.
Qualifying Purchases
Orders
must be placed on http://www.Eurotard.com/FUNDRAISER.html. The cost of the
ordered items must be paid by the retailer to Eurotard
or Eurotard Fundraiser. The cost of the
ordered items must be paid by the purchaser to the retailer selected by
purchaser. Purchasers may return
merchandise to the retailer from which the purchase was made in accordance with
the retailerÕs return policy. Any
merchandise ordered on http://www.Eurotard.com/FUNDRAISER.html,
purchased at the designated retail location, and later returned will not be
eligible for the Eurotard Fundraiser Program. The purchased items may not be returned
or otherwise have a refund issued in order to qualify for the Eurotard Fundraiser Program. The retailer will either not validate
the returned order on the Eurotard Fundraiser website
or will reverse the validation of any returned items ordered on http://www.Eurotard.com/FUNDRAISER.html. No donation will be made to a school for
a non-qualifying or fraudulent purchase.
Payments by Retailers
Payments
to Schools will only be made once (1) payment for the
merchandise is received by Eurotard from the
participating retailer and (2) retailer has validated the order placed on the Eurotard Fundraiser Website. Payments from
retailers for merchandise are generally received by Eurotard
or Eurotard Fundraiser on a monthly or
quarterly basis, but in some cases payments may not be received for several
months from the date of purchase.
If a participating retailer fails to provide payment of the proper
amount for any reasons, including but not limited to bankruptcy or a cessation
of business operations, no donation, or only a partial donation, will be made
to the designated School. Payments
will be made to Schools in accordance with the terms in the ÒPaymentÓ section
of the Official Rules above.
Retailer Liability
Eurotard
and Eurotard Fundraiser are not responsible for, and
do not control, the products and services offered by participating
retailers. Retailers are
responsible for all aspects of their order processing, order fulfillment,
shipping and handling, billing, and customer service. Eurotard and Eurotard Fundraiser are not a party to the transactions
entered into between the purchasers and the retailers with which the purchaser
selects to do business. If a
purchaser buys products or services from retailers through the Eurotard Fundraiser Program, the purchaser becomes a
customer of those retailers and therefore should direct any comments,
complaints, or inquiries regarding the purchase to those retailers and not Eurotard or Eurotard
Fundraiser.
Limited Time Offer
This Fundraiser offer is valid from January 1, 2013 through December 31, 2013,
11:59 p.m. EST. Eurotard and Eurotard
Fundraiser reserve the right to modify the reward amount or to cancel this
offer without prior notice. We
reserve the right to make changes to this policy. Any changes to this policy
will be posted.
